These Terms and Conditions (“Terms”) govern your access to and use of our website www.brickbold.com (“Site”) and related services, including property listings, advertising, and informational resources (collectively, the “Services”).

By accessing or using our Site, you agree to comply with and be bound by these Terms. If you do not agree, please refrain from using our Site.

1. Nature and Scope of Services

Brick Bold is an online real-estate discovery and advertising platform that facilitates the display of property listings (for sale, rent, or lease), promotes real-estate projects and professionals, and offers tools for lead generation, advertising, analytics, and customer engagement. Brick Bold operates solely as an intermediary and does not own, sell, lease, develop, or take possession of properties offered by third parties. Any transaction, negotiation, or contract for sale, lease, or financing is strictly between the User and the third-party advertiser, broker, developer, builder, or financial institution.

2. Eligibility

• You must be at least 18 years old and legally competent to enter into contracts under applicable law to use the Site.
• By registering an account or submitting any content, you represent that you meet this requirement.

3. Account Registration and User Credentials

• Certain features require registration. You must provide accurate, complete, and current information and promptly update it as needed.
• You are solely responsible for maintaining the confidentiality of your username, password, and any other credentials (including OTPs and security words). All activity performed under your account is your responsibility.
• Notify Brick Bold immediately (and confirm in writing) of any unauthorized use, loss, or theft of your credentials. You remain liable for account activity until notification is received and acknowledged by Brick Bold.
• Credentials issued to organizations are for use only by the named organization and its authorized personnel. Sharing or transferring credentials without BrickBold’s prior written consent is prohibited.

4. User Obligations, Representations & Warranties

By using the Site you agree and warrant that you will:

• Provide truthful, accurate, and lawful information during registration and when submitting listings or other content.
• Maintain and secure your own hardware, software, and network connectivity required to access Services.
• Obtain, at your cost, any licenses, permits, consents, or authorizations required to use the Services or to post content.
• Comply with all applicable laws (including RERA, consumer protection, IT laws, tax laws, and local regulations).
• Pay all applicable fees, charges, taxes, and other amounts due for paid Services in a timely manner.
• Promptly cooperate with any verification checks or information requests from Brick Bold.
• Refrain from using another person’s credentials, accessing others’ data, or otherwise exceeding authorized access.

5. Property Listings, Content Submission & Intellectual Property

• Listings and user-generated content (photos, descriptions, floor plans, videos, reviews, ratings, comments) are provided by third-party users (brokers, developers, sellers, agents, owners). Brick Bold does not verify the authenticity, ownership, pricing, availability, or safety of listed properties. Users must independently verify all facts (including RERA registration, approvals, titles, and liabilities) before entering into any transaction.
• By submitting content to Brick Bold you grant VFS Alliance Private Limited a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, distribute, and display such content across current and future media for operational, promotional, analytic, and commercial purposes. “User Data” excludes sensitive financial information (credit card numbers, bank account details). “Individually Identifiable User Data” means data capable of reasonably identifying a person (name, phone, address, email).
• You represent and warrant you own or are authorized to post submitted content and that it does not infringe third-party rights or contain unlawful, defamatory, obscene, or otherwise prohibited material. Brick Bold may remove, edit, or reject any listing or content that violates these Terms or applicable law.

6. Security, Payments & Transactions

Secure Transactions

• Transactions on the Site use encrypted communication channels and reputable, PCI-compliant payment gateways. Brick Bold does not receive, store, or retain credit/debit card numbers; payment details are submitted directly to the selected payment gateway and are subject to that gateway’s terms and security standards. Brick Bold is not responsible for the security practices of payment providers.

User Credentials Protection & Use

• You must protect and not disclose your login credentials. Brick Bold may reassign or change system-generated identifiers (account IDs, mailbox numbers, temporary access codes) at its discretion and without liability.

Loss or Theft of Credentials

• Report loss, theft, or unauthorized access immediately by phone and follow up in writing. You remain responsible for activity until Brick Bold acknowledges receipt of the report.

Prohibited Automated Access

• Use of scripts, bots, scrapers, spiders, deep-linking, or any automated means to access, copy, extract, or replicate Site data is strictly prohibited without prior written permission.

Fraud Disclaimer

• Brick Bold is not liable for fraudulent transactions or unauthorized debits from your bank account. You should report suspected fraud promptly to your bank/payment provider and Brick Bold.

7. Online Communication, Leads & Data Use

• By submitting contact details, you consent to be contacted by Brick Bold, its partners, or advertisers via phone, SMS, WhatsApp, email, or other channels for lead follow-up and service delivery. Brick Bold may record or monitor communications for quality and compliance.
• Brick Bold may store, analyse, and commercially exploit aggregated or anonymized User Data in accordance with the Privacy Policy and applicable laws. Personal or individually identifiable data will be handled per the Privacy Policy and with applicable consents.

8. Paid Services, Advertising, Refunds & Money-Back Package

Paid Services

• Brick Bold offers paid advertising and promotional packages (featured listings, banner ads, priority placement, lead generation campaigns). Each package is governed by the pricing, duration, and terms displayed at purchase.

Refund & Cancellation Policy (General)

• Payments for premium or featured services are generally non-refundable once services are activated, except where Brick Bold fails to activate services within committed timelines or where a verified technical failure attributable to Brick Bold prevents delivery. Approved refunds will be processed within 7–10 business days to the original payment method, subject to applicable deductions (e.g., payment gateway fees).

9. Home Loan Facilitation & Financial Services

• Brick Bold may facilitate loan applications and introductions to Financial Institutions, brokers, or partners for products including Home Loans, Loan Against Property, Balance Transfers, and Top-up Loans. Such facilitation is on a best-efforts basis only. Brick Bold does not make lending decisions; sanction/disbursal/approval is solely at the discretion of the Financial Institution.
• Users opting for loan services expressly consent to be contacted by Brick Bold and partner institutions and accept that Brick Bold may share necessary application data with such partners. Brick Bold does not accept payments on behalf of Financial Institutions and is not liable for unauthorized payments to its employees or third parties.
• Calculators and EMI estimates are indicative and not binding; actual loan terms depend on lender assessment. Brick Bold will not mediate or be liable for disputes between Users and Financial Institutions. Users indemnify Brick Bold against liabilities arising from loan facilitation.

10. Prohibited Activities

You must not, and must not assist others to:

• Access or use the Site for unlawful or unauthorized purposes.
• Upload, post, or transmit content that infringes others’ IP rights, is defamatory, obscene, abusive, discriminatory, violent, or otherwise unlawful.
• Use automated tools to scrape, harvest, or replicate Site content.
• Attempt to breach or circumvent Site security, gain unauthorized access, or probe for vulnerabilities.
• Introduce malware, spyware, ransomware, or any harmful code.
• Spam, send unsolicited bulk messages, or use other services to drive unwanted traffic to the Site.
• Sell, assign, or transfer your account, listings, or subscriptions without BrickBold’s prior written consent.
  Violation may result in content removal, suspension, account termination, forfeiture of fees, and civil/criminal liability.

11. Verification, Moderation & Removal

• Brick Bold may, in its sole discretion, verify, moderate, edit, reject, or remove any listing, account, or content that violates these Terms, applicable law, or Brick Bold policies. Brick Bold is not obliged to pre-screen content but reserves the right to act as necessary to protect Users and the platform.

12. Confidentiality

Definition & Scope

• “Confidential Information” includes non-public commercial, financial, technical, personnel, or other proprietary information exchanged between the parties and reasonably understood to be confidential.

Obligations

• The Receiving Party shall keep Confidential Information secure, limit disclosure to authorized persons on a need-to-know basis, and use it only to perform obligations under these Terms. Disclosure required by law is permitted if the Disclosing Party is notified and, where possible, protective relief is sought.

Return or Destruction

• Upon request or termination, Confidential Information must be returned or securely destroyed, with a certification of destruction where requested.

User-Submitted Data

• Data submitted by Users becomes part of BrickBold’s systems and will be treated in accordance with the Privacy Policy. Brick Bold will take reasonable steps to protect this data but may use and disclose it as permitted under these Terms and the Privacy Policy.

13. Third-Party Links, Advertisers & Services

• The Site may contain links to third-party websites, products, or services and display third-party advertisements. These links and ads do not constitute endorsement by Brick Bold. Brick Bold does not control third parties’ content, services, or privacy practices and is not liable for third-party offerings or transactions between Users and third parties. Users must evaluate third parties and review their terms before transacting. Brick Bold may, at times, integrate or provide access to Third-Party Services; your use of such services is at your own risk and governed by the third party’s terms.

14. Variation, Maintenance, Discontinuation & Service Changes

• Brick Bold may modify, suspend, or discontinue any portion of the Site or Services (temporarily or permanently) at any time without notice. Routine maintenance or upgrades may cause temporary interruptions. Brick Bold will not typically refund fees for routine maintenance interruptions unless explicitly promised. For paid services discontinued by Brick Bold, Brick Bold may, in its discretion, provide a pro-rated refund for unused time where appropriate.

15. Limitation of Liability & Disclaimer of Warranties

Disclaimer

• The Site and Services are provided “as is” and “as available.” Brick Bold disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of listings or content.

Limitation of Liability

• To the maximum extent permitted by law, Brick Bold, its affiliates, officers, employees, agents, or licensors shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of profits, loss of data, business interruption, or legal claims) arising from your use of the Site, reliance on content, interactions with third parties, or participation in transactions. BrickBold’s aggregate liability, if any, shall not exceed the amount paid by you for the particular service giving rise to the claim (if any).

16. Indemnification

• You agree to indemnify, defend and hold harmless Brick Bold and its officers, directors, employees, agents, affiliates, partners, and licensors from and against any losses, liabilities, claims, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your violation of applicable law; (c) your content or listings; (d) your use or misuse of the Site; or (e) any disputes with third parties.

17. Termination & Suspension

• Brick Bold may suspend or terminate your access to the Site and Services, remove content, or cancel accounts at any time for violations of these Terms or for any other reason, with or without notice. Upon termination, your right to use the Services ceases immediately. Brick Bold may retain certain information as required by law or for legitimate business purposes.

18. Governing Law & Dispute Resolution

• These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ludhiana, Punjab, unless otherwise required by applicable law. Nothing in these Terms limits BrickBold’s right to seek injunctive or equitable relief.

20. Taxes & Fees

• You are responsible for all applicable taxes, duties, levies, or other governmental charges related to your use of paid Services, as required by law.

21. Notices and Communication

22. Severability & Waiver

• If any provision of these Terms is found invalid or unenforceable, the remainder shall continue in full force. Failure by Brick Bold to enforce any right does not constitute a waiver of that right.

23. Entire Agreement

• These Terms, together with any referenced policies (Privacy Policy, Refund & Cancellation Policy, Broker Registration Terms), constitute the entire agreement between you and Brick Bold concerning the subject matter and supersede all prior agreements and understandings.

By using the Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and by the Privacy Policy and any other policies referenced herein.
